1. The licence
Kohbyn Ellacott, a sole trader in Australia (ABN 37 899 316 456), grants a non-exclusive, non-transferable licence to use Canopy Field Manual. Noble Court Yards is the registered business name of that sole trader. For a personal plan the licence is for you, for your landscaping work, your study, or your own garden. On Curator the licence is for the named seats of that firm. The account on the bill is an office seat. A crew seat may read a job and mark a plant planted, and may not change the price. The licence lasts while this agreement is kept and the plan still includes the part in use.
2. What you may do
You may read the plant library by name.
On a plan that includes them, you may run the Situation filter, save projects, and export or email The Brief for a client of yours or for your own garden. You may quote a short part of a dossier if the botanical name and the citation stay attached.
3. What you may not do
- Copy the library into another product, or into a database you sell.
- Remove the Canopy mark from The Brief and present the list as uncited research.
- Share one paid login around a firm instead of a named seat for each person.
- Stay signed in on more than three devices at once. Sign out of one to use another.
- Reverse engineer the service, except where Australian law allows it.
- Treat an edible mark or a toxic mark as a certificate that a plant is safe.
4. When a plan ends
The licence for the Situation filter, new or edited projects, The Brief, and Community Notes lasts only while the plan that includes them is current. When a plan ends — including the day a Buddy Student tuition date has passed — those parts of the licence end. Reading the library by name, and the citations, remains on Pioneer. A project you already saved can still be opened, but you cannot add to it or export The Brief until a paid plan is current again.
5. What you type
You own the notes, names, and addresses you type. You allow Noble Court Yards to store them and show them back to you, and to show a Community Note on its dossier after it is approved, and to take a reported note off, as the Privacy Policy describes. The plant records and the arrangement of the library stay with Noble Court Yards, except for the sources named on each dossier, which stay with their authors.
6. Ending the licence
You may stop using Canopy at any time. Noble Court Yards may end the licence if you break this agreement or the Terms of Service. Where the misuse is not urgent, you will be told through the contact form first. Ending the licence does not by itself delete a project. Ask for the account to be closed if you want the saved projects removed.
7. The rest of the bargain
Price, payment, cancellation, the Australian Consumer Law, and liability are in the Terms of Service. What is held about you, and how to ask for it or have it deleted, is in the Privacy Policy. Those two documents and this agreement are one bargain. The same date, the same parties, and the laws of Queensland, Australia apply to all three.
