1. Who you are dealing with
Noble Court Yards is the registered business name of Kohbyn Ellacott, a sole trader in Australia (ABN 37 899 316 456). Canopy, also called Canopy Field Manual, is a product of that business. These terms cover the website, accounts, and paid plans. The End User Agreement covers what the licence lets you do with the software. The Privacy Policy covers personal information. If they disagree, these terms win on price, payment, and liability, the End User Agreement wins on the licence, and the Privacy Policy wins on personal information.
2. What Canopy is, and is not
Canopy helps a landscape gardener, a student, or a home gardener match plants to a described growing situation, save that situation on a project, and export The Brief for the plants that fit. It is a decision aid. It is not a site inspection, not a promise that a plant will thrive, and not advice that a plant is safe to eat, touch, or plant beside a child or an animal.
An edible mark or a toxic mark is a note on the dossier, not a certificate. A weed note applies only in the situation described on that page. It is not a complete legal weed declaration for every state or council. Check the plant on the ground, and read the sources cited on the dossier, before you specify it, eat it, or tell a client it is safe.
3. Accounts
The library can be read by name without an account. An account is required to save a project or to subscribe. You are responsible for your login. One account may be signed in on three devices at once. Sign out of one before a fourth. Do not share one paid login as a substitute for another person. On Curator, each person has a named seat.
4. Plans and price
Prices are in Australian dollars (AUD). GST is not charged. Projects are not counted.
- Pioneer. Read the library by name, and the citations. The Situation filter, saved projects, and The Brief are not included.
- Buddy Student, AUD 120 a year. The working tools while the tuition end date you give is still current. After that date the account returns to Pioneer. The institution and the date must be real. Noble Court Yards may end the student plan if the enrolment is not genuine.
- Arboreteur, AUD 35 a month or AUD 300 a year. The Situation filter, saved projects, and The Brief, by PDF or email.
- Landwright, AUD 55 a month or AUD 480 a year. Everything in Arboreteur, plus Community Notes. A project may list nurseries already held, starting with the Brisbane intake. A national stock search is not part of the service until it is switched on and described as such in the app.
- Curator, AUD 149 a month or AUD 1,490 a year. Everything in Landwright, for a firm. Four named seats are on the one bill. The account on the bill is an office seat. Any other seat may be office or crew. An office seat may change the job. A crew seat may read it and mark a plant planted, and may not change the price. The firm’s name and ABN are printed on The Brief. A further seat is AUD 29 a month or AUD 290 a year, up to 12. That extra charge is not switched on yet. A firm that needs more than 12 seats should write through the contact form.
If Noble Court Yards later registers for GST, the price shown before your next payment will say so. A price change does not alter a period you have already paid for.
5. Paying and cancelling
When charging is switched on, payments are taken by Stripe. Noble Court Yards does not store your card number. You may cancel at any time by writing through the contact form, or through the link on a Stripe receipt when that link is available. Cancellation stops the next charge. The tools stay available until the end of the period already paid.
Nothing in these terms takes away a right or remedy the Australian Consumer Law says cannot be excluded. Where that law does not require a refund, fees for the current period are not refunded, because the paid tools remain available until that period ends.
6. Projects and site addresses
You keep the notes and addresses you type into a project. A site address may be a client’s address. Store it only when you have a proper reason. Noble Court Yards keeps it so the project works, and so a later local nursery distance can be measured from it. On Curator, the named seats of that firm can open the jobs in the firm’s book. A crew seat may mark a plant planted and may not change the price. A short record is kept of who changed a job. Words typed into the Situation box may be sent to a model so the filter can be filled. Do not put a client’s address in that box. Do not put card numbers or passwords into a project.
7. Community Notes
On Landwright or Curator you may submit a note on a dossier. You are responsible for it. Keep it about the plant. Do not use it to attack a person, and do not paste another author’s pages into it. A note is shown only after Noble Court Yards approves it, and it may be declined. Anyone with an account may flag a dossier, rate a note that is showing, or report that note. A report is read by Noble Court Yards, and the note may be taken off.
8. Acceptable use
Do not scrape the library to build or sell a competing product. Do not strip the citations off The Brief and present the list as uncited work. Do not try to break accounts or payments. Do not tell a client a plant is safe to eat or safe to handle on the strength of a mark alone.
9. The library
Plant records point back to the sources named on each dossier. The selection, the arrangement, and Noble Court Yards’ own notes are part of Canopy. Noble Court Yards does not promise that the library is complete or free of mistakes. When published advice disagrees, flag the dossier.
10. Liability
To the extent the Australian Consumer Law allows a limit, Noble Court Yards is not liable for a plant that fails, a dispute with your client, or a loss that follows from using a dossier without checking the site and the cited sources. Nothing here excludes a guarantee or remedy that the Australian Consumer Law says cannot be excluded. Where liability can be limited, it is limited to the fees you paid Noble Court Yards for Canopy in the three months before the claim.
11. Privacy
Personal information is handled as set out in the Privacy Policy. Noble Court Yards does not sell it. Stripe handles the card. You may ask for the account to be closed through the contact form.
12. Changes
Noble Court Yards may update these terms. The date at the top will change, and the current terms stay linked from every page. Continued use of a paid plan after a change means the new terms apply from the next period you pay for.
13. Law
These terms are governed by the laws of Queensland, Australia. The courts of Queensland have jurisdiction.
